Teach Starter Referral Program

The Referral Program (“Program”) is managed and conducted by Teach Starter Pty Ltd ABN 69 634 768 817 (“Teach Starter”, “we”, or “our”) for the benefit of its customers (“you” or “your”).

By opting into, or participating in, the Program, you agree to comply with the Terms and Conditions for the Program set out here (“Terms and Conditions”) as well as the General Terms and Conditions and our Privacy Policy.

Please read these Terms and Conditions, the General Terms and Conditions and our Privacy Policy carefully before you participate in and/or opt into the Program, as they form a binding agreement between you and Teach Starter in respect of the Program.

Refer to our Privacy Policy at https://www.teachstarter.com/about/privacy-policy/ for more details regarding use of your personal information and opt out procedures and the terms and conditions at https://www.teachstarter.com/au/about/terms-and-conditions/ (“General Terms and Conditions”). In the event of any inconsistency between these Terms and Conditions and the General Terms and Conditions and/or Privacy Policy, these Terms and Conditions will take precedence to the extent of such inconsistency.

In these Terms and Conditions:

  • Advocate” means an existing Teach Starter subscriber who actively recommends Teach Starter to others. For clarity, only natural persons with an active Teach Starter paid subscription at the time of a Referral can be an Advocate within the meaning of these Terms and Conditions.
  • Participant” means an Advocate and/or Referred User, as the context requires.
  • Qualifying Annual Subscription” means a Teach Starter Plus Plan (annual) subscription.
  • Referral” is a purchase of a Qualifying Annual Subscription made by a Referred User using an Advocate’s unique referral discount code and which otherwise meets the requirements of these Terms and Conditions.
  • Referred User” means a user who, as a result of an Advocate’s referral, signs up for a Qualifying Annual Subscription.

1. Referral Conditions

a. If a Referred User does not use/redeem a relevant unique discount code to make a purchase, purchase of a Qualifying Annual Subscription will not constitute as a Referral.

b. For every unique purchase of a Qualifying Annual Subscription made by a Referred User because of a Referral, the Advocate will get a credit amount as detailed below as part of the Program. Referrals are subject to verification and the Referred User must be a new or returning paid customer to Teach Starter. In order to be eligible, Referred Users must be able to show that their prior Teach Starter subscription was cancelled or otherwise came to an end at least 6 months prior to the commencement of the new subscription.

c. Teach Starter: (i) is not required to provide a credit for a Referral; (ii) may disqualify any Advocate from participating in the Program; or (iii) may cancel any reward provided to a Participant where Teach Starter, at its discretion, deems that: (iv) an Advocate has referred a Referred User under fraudulent or suspicious circumstances; (v) an Advocate has interfered with the entry process or the operation of the Program in any way; and/or (vi) a Participant is otherwise in breach of these Terms and Conditions, including by engaging in any of the activities described in section 4 below.

2. Advocate Rewards

a. If the Referral conditions in section 1 above are met, for each new successful Qualifying Annual Subscription purchased by a unique Referred User, the Advocate will be awarded a $10 credit, with a maximum accumulated limit of $200 in credits (20 users referred).

b. The accumulated credits will be automatically applied to the Advocate’s Teach Starter account and used as a discount on their next annual subscription renewal.

c. Cancellation or of an Advocate’s Teach Starter subscription prior to renewal, or non-renewal of that subscription, will void all unused credits.

d. Credits earned by Advocates are non-transferable and cannot be exchanged for cash or any other form of payment or discount.

e. The credits earned by Advocates will expire after 2 years from the date they were earned. For example, if an Advocate earns a credit on January 1, 2023, it will expire on January 1, 2025.

f. Expired credits will no longer be valid or available for use and cannot be reinstated.

3. Referred User Rewards

a. If the Referral conditions in section 1 above are met, Teach Starter will award the Referred User a 10% reduction in the cost of a paid Qualifying Annual Subscription.

b. Referred Users who use an Advocate’s Referral code to receive a 10% discount on their purchase of a Qualifying Annual Subscription will not be eligible for a refund on that subscription as may otherwise be permitted under the General Terms and Conditions, except where a refund is required by law.

c. The discount provided to a Referred User is non-transferable.

4. Prohibited Activities

a. Advocates must not engage in fraudulent or deceptive practices to obtain Referrals. This includes, but is not limited to, creating fake accounts or providing false information.

b. Advocates must not breach the Spam Act 2003 (Cth) or otherwise use spam or unsolicited communication methods to promote the Program. This includes sending referral codes to individuals who have not explicitly expressed an interest in receiving them.

c. Use of any affiliate website, affiliate network properties, automated systems, script, or macro to participate or identify potential Referred Users is strictly prohibited and will result in disqualification.

d. Advocates may not enter with multiple or fake email addresses or accounts, use fictitious identities or use any system, bot or other device or artifice to participate in the Program or receive a reward.

5. Changes to the Program

a. Teach Starter reserves the right to change, limit or terminate this Program at any time without any justification being required, including by posting a new version of these Terms and Conditions on its website. Teach Starter will take reasonable steps to inform Participants of any significant changes to the Program and/or these Terms and Conditions, however we recommend that Participants to regularly check the website for changes to these Terms and Conditions and/or the Program.

b. In the event of termination of the Program by Teach Starter, any unused credits will remain valid and will be applied towards the subsequent renewal of the Advocate’s subscription.

6. General Provisions

a. Participants agree to indemnify, defend, and hold Teach Starter harmless from and against any and all third-party claims, demands, liabilities, costs, or expenses, including attorney's fees and costs, arising from or related to any breach of these Terms and Conditions by the Participant or any violation of applicable laws they may commit.

b. These Terms and Conditions are governed by the laws of New South Wales. The parties submit to the jurisdiction of the courts of New South Wales and courts of appeal from them. The parties will not object to the exercise of jurisdiction by those courts on any basis.

c. With regard to the limitation of Teach Starter's liability in connection with the Program, we refer to our General Terms and Conditions available at https://www.teachstarter.com/au/about/terms-and-conditions/.


Teach Starter Gift Cards

You can use Teach Starter gift cards to pay for your Teach Starter subscription or to give as a gift. Teach Starter gift cards can be purchased online and redeemed at TeachStarter.com.

Gift cards are issued electronically via email.

A gift card may be used toward the purchase price of any Teach Starter subscription. If the purchase price of the subscription exceeds the value of the gift card, the purchaser will be charged the balance of the purchase price.

Gift cards do not expire.

Gift cards are non-refundable. Once a Teach Starter gift card is applied to an account, you can access your Teach Starter subscription until the gift card balance runs out.

Discount codes can't be applied to gift card purchases, and gift cards If the value of the gift card exceeds the purchase price of the Teach Starter subscription, the balance of the gift card value will remain on the gift card and can be applied to the purchase of a future subscription. It is not applied as a credit to your account and can't be applied to PO purchases.

Gift card holders may only redeem the card for cash when the face value of the card has declined to an amount less than $10 and the card has been used for at least one purchase.

Gift cards cannot be reloaded.

If there is any inconsistency between the Terms and Conditions for this Competition and anything else that refers to this Competition, these General Terms and Conditions will prevail to the extent of the inconsistencies.

Who can enter:

Entry is open to all Australian residents (and New Zealand residents as applicable) who meet any specific requirements stipulated by the Promoter in the Competition Terms and Conditions above. Entrants must be 18 years of age or older as at the date of entry in order to be eligible to enter the Competition.

How to enter:

There is no entry fee and no purchase necessary to enter this Competition.

Entrants may enter the Competition by completing the Competition entry form found on the promotional website or as specified by the Promoter in the individual competition terms and conditions. The cost of accessing the promotional website will be dependent on the Entrants’ individual Internet Service Provider and will be at the cost of the Entrant.

Only one entry per Entrant will be permitted in each individual Competition draw, unless otherwise stipulated by the Promoter.

Where there is a major prize for a competition, all Entrants will have an equal chance of winning the major prize at the start of the Competition.

Once an entry is submitted, Entrants acknowledge that the entry may not be withdrawn, altered, or deleted (except as and where required by the Promoter).

Prize Draw:

This is a promotional game of chance that is conducted to promote goods and services.

Unless the Terms and Conditions state otherwise, the game will be drawn within one (1) year of the day the Competition starts.

The prizes will be drawn in descending value (if applicable) and the game will only allow for one (1) round of elimination of players.

The Promoter’s decision is final, and no correspondence will be entered into.

The Promoter reserves the right to redraw the prize if an Entrant who claims to be a prize winner is unable to satisfy these Terms and Conditions, provide adequate photo ID or is unable to claim the prize.

Notification of winner:

The winners will be notified via the email address provided by Entrants when entering the Competition, unless otherwise stipulated by the Promoter.

If the Entrant’s contact details change during the promotional period, it is the Entrant’s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.

The Promoter will notify the winner of when and where the prize can be collected.

The Promoter will make all reasonable efforts to deliver the prize to the winner of the Competition within seven (7) days of the Prize Draw. The winner agrees to be notified of the win after one (1) month of the date of the Prize Draw if the Promoter has made all reasonable efforts to locate the winner.

Entrants agree that their right to a prize is forfeited if they have not claimed the prize within seven (7) days and the Promoter can re-draw winners for unclaimed prizes.

The results of the Competition will not be published unless the Promoter notifies the Entrants otherwise.

Prize on offer:

The prize is as stated. The prize is subject to availability and the Promoter reserves the right to substitute the prize with another prize of equivalent value without giving notice.

It is a condition of accepting the prize that the winner be required to sign a legal release in a form determined by the Promoter in its absolute discretion.

Changes to Competition:

The Promoter will not be liable for any delay or default in performance if it is caused by any event or circumstances reasonably beyond the control of the Promoter including any Act of God, act of any governmental or competent authority, cancellation in whole or part of any events, summits or conferences at which the Competition is intended to be run or any health epidemics or pandemics, including COVID-19. If such causes are not reasonably able to be overcome, then the parties will negotiate in good faith alternative arrangements.

The Promoter will not be liable for any costs incurred by an Entrant if for any reason this Competition is not capable of running as planned, including but not limited due to tampering, unauthorised intervention, fraud, any technical difficulties or equipment malfunction or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this Competition.

Privacy:

A copy of the Promoter’s Privacy Policy in relation to the treatment of Personal Information collected in connection with this Competition may be accessed on the Promoter’s website at: https://www.teachstarter.com/about/privacy-policy/ .

The Promoter collects the Entrant's personal information, including their name and email address, for the purpose of conducting and promoting this Competition (including but not limited to determining and notifying the winners). The Promoter collects and uses that information to provide Entrants with goods and services of the Promoter and to promote and improve the Promoter’s goods and services. If an Entrant is not willing for this to occur, they cannot participate in the Competition.

An Entrant who opts to receive marketing material also agrees that the promoter may use personal information collected to conduct the Competition, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the Entrant, including sending the Entrant electronic messages. A request to access, update or correct any information should be directed to the Promoter.

All entries will be entered into a database and the Promoter may use the Entrant’s names and email address for future promotional, marketing and publicity purpose in any media worldwide without notice and without any fee being paid unless otherwise advised by the Entrant. By entering this Competition, Entrants confirm that they allow their details to be used for this purpose. If Entrants no longer consent to their details being used for future marketing purposes, the Entrant should contact the Promoter on their details set out below. Intellectual Property:

All entries (in any form, including without limitation in hard copy or electronic form) become the property of the promoter and the Entrant agrees to assign all rights and title in the entry without further reference, payment or other compensation.

By submitting, uploading, transmitting, posting or otherwise making available any materials, including but not limited to answers to questions, a statement, an idea or opinion, video or voice recordings, images, works of art, design or photographs (Material) to the Promoter, the Entrant agrees to grant to the Promoter:

  1. a non-exclusive, worldwide, royalty-free, perpetual, licence to use, reproduce, edit and exploit the Material in any form (including on the Promoter’s website and social media platforms) in association with the Competition; and
  2. a sub-licence in relation to any of the Promoter’s related bodies corporate, or agencies or companies associated with the Promoter for any purpose in relation to the Competition.

The Entrant warrants that it has the right to grant the above-mentioned licences.

By entering the Competition, Entrants:

  1. warrant that their entry is not, and its use by the Promoter will not be, in breach of any third-party intellectual property rights; and
  2. expressly consent pursuant to the moral rights provisions of the Copyright Act 1968 (Cth) to the Promoter having unfettered right to treat their entry in a manner at its sole discretion, to alter their entry in any manner and to the Promoter not attributing authorship of their entry to the Entrant; and
  3. will, at the Promoter’s reasonable request and at the Promoter’s cost at all times do all things (including signing all documentation) necessary to give effect to the requirements of this clause.

In consideration for the Promoter awarding the prize to the winner, the winner hereby permits the winner’s submission, image and/or voice, as recorded, photographed or filmed during the winner’s participation in the prize, or in the subsequent advertising or marketing activities undertaken by the Promoter. The winner will not be entitled to any fee for such use.

Use of social media & virtual photo booth platforms:

The Promoter is permitted to require the Entrant to submit their entry via social media platforms and/or by using virtual photo booth platforms.

An Entrant’s entry on the social media platforms and/or virtual photo booth platforms must be submitted by the individual Entrant.

An Entrant must ensure their security settings on their personal account allows the Promoter to contact them in the event that the Entrant is a winner.

The winner is solely responsible and liable for the content of their entries and/or posts and any other information they transit to other Internet users.

The following terms apply to the extent that the Competition is conducted on, advertised or promoted on a social media platform or a virtual photo booth platform owned by a third party (Platform Operator) the Entrant acknowledges and agrees that the Competition is in no way sponsored, endorsed or administered by, or associated with any Platform Operator.

Statutory Guarantees and Limitation of Liability:

Any guarantee or warranty given in relation to a prize is in addition to any relevant statutory guarantees and warranties and nothing in these Terms and Conditions restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth).

The promoter and its associated agencies and companies will not be liable for any loss (including without limitation indirect, special or consequential loss or loss of profits), expense, damage, claim, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence or wilful misconduct) in connection with this Competition or accepting or using any prize (or recommendation) except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum amount allowable by law).

The winner is responsible for all other expenses not covered by the prize package.
